Nonprofit Status

The Commonwealth Legacy Foundation is a registered nonprofit organization in the Commonwealth of Massachusetts.
Our application for federal tax-exempt status under Section 501(c)(3) of the Internal Revenue Code is currently pending approval, with a determination anticipated by mid-October.

Until IRS recognition is formally granted, contributions may not yet be tax-deductible for federal income tax purposes. Once exemption is approved, it is expected to be retroactive to the Foundation’s formation date, in accordance with IRS policy for newly established charitable organizations (see IRS Revenue Procedure 2017-5).

Important Donor Information

• No goods or services were provided in exchange for this contribution unless otherwise noted.

• Donors are encouraged to consult their tax advisor regarding the deductibility of their gift once IRS recognition is finalized.

• All contributions will be used to advance the Foundation’s charitable mission of expanding youth access to UMass Athletics events, programs, and community engagement initiatives.

Legal Disclosure

Pursuant to IRS regulations, while 501(c)(3) status is pending, organizations must not represent contributions as currently tax-deductible. However, if tax-exempt status is approved, the determination letter will confirm that donations are retroactively tax-deductible to the date of the Foundation’s incorporation.

This disclosure ensures compliance with both federal charitable solicitation standards and Massachusetts nonprofit regulations.
